Rosebud Man Pleads Guilty to Failure to Register as a Sex Offender

United States Attorney Brendan V. Johnson announced that David Eagle Bear, age 28, of Rosebud, South Dakota, appeared before United States District Judge Roberto A. Lange on July 7, 2011. Eagle Bear pled guilty to Failure to Register as a Sex Offender. The maximum penalty upon conviction is 10 years imprisonment, a $250,000 fine, or both.

Eagle Bear was convicted of Abusive Sexual Contact on or about August 5, 2008. The Court sentenced Eagle Bear to 36 months’ imprisonment and also ordered that he must register as a sex offender. Eagle Bear is required to register bi-annually. After Eagle Bear was released from prison, he relocated to the Rosebud Sioux Indian Reservation but did not register as a sex offender from approximately March 5, 2011, to April 7, 2011.

The investigation is being conducted by the United States Marshal's Service and Rosebud Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Tim Maher.

A presentence investigation was ordered, and a sentencing date was set for October 4, 2011. The defendant was remanded to the custody of the United States Marshal pending sentencing.
